Because regulations can vary by state and specific circumstances, employers should verify applicable state requirements and consult qualified legal counsel or a safety professional when needed, particularly in complex or uncertain cases.<\/span><\/i><\/p>\n<h2><b>Work-related injury and illness reporting vs recording &#8211; What\u2019s the difference?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">If you\u2019re required to report a work-related injury, this means you must contact OSHA directly and explain the incident. <\/span><i><span style=\"font-weight: 400;\">Recording<\/span><\/i><span style=\"font-weight: 400;\"> of injuries happens internally, i.e., you outline the incident in your company\u2019s internal safety logs.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You\u2019re obligated to <\/span><b>report <\/b><i><span style=\"font-weight: 400;\">and record<\/span><\/i><span style=\"font-weight: 400;\"> a work-related incident if it results in:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Fatality<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Serious injury &#8211; as defined by OSHA. <\/span><i><span style=\"font-weight: 400;\">Not all injuries that are medically serious fall under OSHA\u2019s definition.<\/span><\/i><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Most standard injuries only need to be <\/span><b>recorded <\/b><span style=\"font-weight: 400;\">for employers to be fully compliant.<\/span><\/p>\n<p style=\"padding-left: 40px;\"><b><i>Related &#8211; <\/i><\/b><a href=\"https:\/\/www.cardinus.com\/us\/state-health-safety-enforcement-and-your-ergonomics-program\/\"><i><span style=\"font-weight: 400;\">The state of health and safety enforcement &#8211; and your ergonomics program<\/span><\/i><\/a><\/p>\n<h2><b>Workplace injury reporting timelines for employers (most states)<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">How soon you\u2019re obligated to record a workplace injury is largely determined by the severity of the incident. Overall, however, these OSHA-defined windows are relatively short, so swift action is important to maintain regulatory compliance.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">How long do you have to report a fatal work-related incident?<\/span><\/h3>\n<p><b>Timeline for fatal workplace incidents: 8 hours<\/b><\/p>\n<p><span style=\"font-weight: 400;\">In the tragic event that a workplace incident results in the death of an employee, there is an 8-hour window to report it to OSHA. This seems like a short period of time, but, importantly, the clock starts ticking the moment the employer or an agent of the employer (i.e., a manager or supervisor) learns of or <\/span><i><span style=\"font-weight: 400;\">should know<\/span><\/i><span style=\"font-weight: 400;\"> about the incident, not when the incident itself occurs.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">There\u2019s also an exception to bear in mind: the 8-hour window for reporting work-related fatalities only applies within 30 days of the initial incident.\u00a0<\/span><\/p>\n<p><b>What happens if the work-related fatality occurs after 30 days?<\/b><\/p>\n<p><span style=\"font-weight: 400;\">If an employee passes away from their work-related injuries on day 31 or later, you are no longer required to report directly to OSHA. However, you are still legally required to record the death. This means you must update your internal OSHA 300 logs to reflect the fatality within 7 calendar days of learning about it.<\/span><\/p>\n<p>Also, bear in mind that if it fell into a non-fatal reportable category, the initial injury should have been reported.<\/p>\n<h3><span style=\"font-weight: 400;\">How long do you have to report severe injuries or illnesses related to work?<\/span><\/h3>\n<p><b>Timeline for severe work-related injuries or illnesses:<\/b> <b>24 hours<\/b><\/p>\n<p><span style=\"font-weight: 400;\">When an employee suffers serious, <\/span><i><span style=\"font-weight: 400;\">non-fatal<\/span><\/i><span style=\"font-weight: 400;\"> injuries or illness while working, the employer has 24 hours to report the incident.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In this type of scenario, it\u2019s important to understand what \u201cserious injury\u201d means so you\u2019re clear on your reporting responsibilities.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In short, a non-fatal work-related injury or illness is classed as serious if the incident involved any of the following:<\/span><b><\/b><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"margin-bottom: 15px;\"><b>In-patient hospitalization &#8211; <\/b>Formal hospital admission for treatment. This excludes hospitalization for observation purposes only.<\/li>\n<li style=\"margin-bottom: 15px;\"><b>Amputation &#8211; <\/b>This includes any amputations, regardless of severity &#8211; from whole limb to partial finger loss.<\/li>\n<li><b>Loss of an eye &#8211; <\/b>According to OSHA, the &#8220;loss of an eye&#8221; category for the 24-hour reporting requirement refers to physical enucleation (the removal of the eyeball) or evisceration (removal of the internal contents of the eyeball). However, permanent loss of sight without removal of the eye is still almost always reportable within 24 hours because it may still require in-patient hospitalization, which triggers the report anyway.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">If an employee is formally admitted to hospital for treatment more than 24 hours after the initial incident, you\u2019re no longer required to report it, but it is still a recordable event.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">How long do you have to report minor recordable work-related injuries?<\/span><\/h3>\n<p><b>Timeline for standard recordable work-related injuries: 7 days<\/b><\/p>\n<p><span style=\"font-weight: 400;\">A standard recordable work-related injury should be recorded in an employer\u2019s internal OSHA log within 7 calendar days of the incident.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The types of injuries that fall into this category include:<\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Minor fractures<\/b><span style=\"font-weight: 400;\">, such as a broken finger or toe<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Sprains or strains<\/b><span style=\"font-weight: 400;\"> that require medical treatment beyond first aid (e.g., physiotherapy or prescription medication)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Cuts or lacerations requiring stitches<\/b><span style=\"font-weight: 400;\"> or surgical glue<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Minor burns<\/b><span style=\"font-weight: 400;\"> that require prescription treatment<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Repetitive strain injuries<\/b><span style=\"font-weight: 400;\">, such as <\/span><a href=\"https:\/\/www.cardinus.com\/us\/4-ergonomics-principles-prevent-carpal-tunnel\/\"><span style=\"font-weight: 400;\">carpal tunnel syndrome<\/span><\/a><span style=\"font-weight: 400;\"> diagnosed by a healthcare professional<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Foreign objects in the eye<\/b><span style=\"font-weight: 400;\"> that require removal by a medical professional<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Concussions<\/b><span style=\"font-weight: 400;\"> without hospitalization<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Work-related hearing loss<\/b><span style=\"font-weight: 400;\"> confirmed by a medical evaluation<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Injuries requiring prescription medication<\/b><span style=\"font-weight: 400;\">, even if the injury itself is minor<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Injuries resulting in restricted duties<\/b><span style=\"font-weight: 400;\">, such as light duty for several days<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Injuries requiring time off work<\/b><span style=\"font-weight: 400;\">, even if only for a few days<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2><b>When is a work-related injury non-recordable?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Generally, employers don\u2019t have to record a work-related injury if normal first aid was a sufficient response. Injuries requiring medical treatment beyond standard first aid, that lead to days away from work, restrict work, or result in loss of consciousness are recordable.<\/span><\/p>\n<h2><b>State-specific reporting or recording obligations for work-related injuries, illnesses, and fatalities<\/b><\/h2>\n<h3><span style=\"font-weight: 400;\">California<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Work-related injury and illness reporting in California diverges significantly from federal standards. First, it\u2019s crucial to note that California legislation doesn\u2019t use the same <\/span><i><span style=\"font-weight: 400;\">in-patient hospitalization \/ amputation \/ eye loss <\/span><\/i><span style=\"font-weight: 400;\">definition of serious injury or illness. It uses a broader definition: <\/span><i><span style=\"font-weight: 400;\">\u201cserious injury or illness (excluding minor injuries requiring only first aid\u201d<\/span><\/i><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Timelines also differ.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">California legislation demands more immediate action than most states for all fatal and serious non-fatal work-related injuries and illnesses. The Golden State requires employers to report as soon as practically possible, with 8 hours serving as the hard deadline.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Furthermore, in California, there is no 30-day exemption for recording work-related fatalities. Even if an employee dies due to complications with a work-related injury after the 30-day window, you\u2019re required to report the fatality to OSHA within 8 hours of finding out.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If an employer can <\/span><i><span style=\"font-weight: 400;\">prove<\/span><\/i><span style=\"font-weight: 400;\"> \u201cexigent circumstances\u201d that made the 8-hour window impossible, the acceptable window for reporting is 24 hours. But it\u2019s a very high bar to clear (e.g., total communication failure in a remote area), so it\u2019s crucial never to rely on being able to claim this extension.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Oregon<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Oregon categorizes three or more in-patient hospitalizations related to the same work incident as a \u201ccatastrophe\u201d that requires an immediate on-site OSHA presence. Catastrophe events have an 8-hour rather than 24-hour reporting window, from when the employer finds out.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Washington (DOSH)<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">In Washington, any in-patient hospitalization must be reported to the Department of Labour &amp; Industries, Division of Occupational Safety and Health (DOSH) within 8 hours rather than 24 hours.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Arizona<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">OSHA requirements in Arizona largely align with federal standards. It\u2019s workers\u2019 compensation reporting that deviates from the norm.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For fatal work-related incidents, employers must notify the Industrial Commission of Arizona (ICA) within 24 hours. For any other injury, the employer has 10 days to file an official \u201cEmployer\u2019s Report of Injury\u201d with the state.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Under Arizona workers\u2019 compensation rules, employers must notify the Industrial Commission of a work\u2011related fatality by the next business day, and must file an Employer\u2019s Report of Injury within 10 days of notice of any accident.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Insurers or administrators may impose stricter contractual deadlines (for example, 24 hours to notify the carrier about fatalities), so employers should check their policy requirements.<\/span><\/p>\n<h2><b>A proactive approach to injury prevention and recordkeeping<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Preventing workplace injuries starts with better visibility and proactive risk management.
